Brain Injury Lawsuit Argued in High School

The Colorado Court of Appeals is turning a trial into a learning experience by hearing oral arguments at Central High School on October 16.

The event is part of Courts in the Community, an outreach program sponsored by the Colorado Judicial Branch to show students how the American court system works.

Judges will hear one case concerning a Broomfield high school student who sustained a traumatic brain injury in 2011. According to court documents, the boy was struck by a baseball twice in the same month.

His parents claim he displayed signs of a concussion after both incidents, but the coach failed to get him medical attention. Instead, he allowed the injured teen to continue practicing, despite a recent education on head injuries. The victim’s parents are suing the coach, the school district and several other individuals for negligence.

Traumatic brain injuries are especially harmful to children and adolescents, because their brains are still developing. High school coaches are taught how to manage head injuries, because they can have dramatic, and permanent, consequences.
