In Lieu of Criminal Charges, Victim’s Family Files Suit

Samuel Munz was almost home when the accident happened. He slowed down to turn left into his driveway when Theresa Ruf’s SUV crashed into him from behind. He died soon after the accident.

Munz’s family is still waiting to hear if Ruf will face charges. In a January 16 article on SaukValley.com, a spokesperson said that the state attorney’s office is still looking into the accident.

In the meantime, Jacob Munz, the executor of Samuel’s estate, filed a motorcycle accident lawsuit against Ruf. It accuses her of driving at a speed that endangered the victim’s safety, failing to keep a proper lookout and failing to reduce speed to avoid an accident.

Ruf says that the sun was in her eyes at the time, even though the accident report says that the sun was very low in the sky and not a contributing factor in the crash. The report goes on to mention that in instances of bright sunlight, affected drivers must slow down to prevent accidents. Ruf also claimed that his brake light was too small.
