Injured Swimmer Sues Hotel for Waterslide Accident

Robert and Dale Flowers were spending Valentine’s Day at the Country Springs Hotel in Waukesha, Wisconsin. The hotel had a waterslide called the Cyclone. Two lifeguards – one stationed at the top of the slide and the other at the finishing end – worked together to let swimmers know when the slide was safe to use.

Robert got the all clear and went down the slide, finishing the run in a flat, trough-like portion. As he stood up to exit the slide, another guest crashed into him. He fell over and hit his head on the slide. He filed a lawsuit against the hotel, claiming that it is responsible for his injuries, hospital bills, lost wages, suffering, pain, disability and loss of earning capacity. According to the lawsuit, his wife suffered from “the loss of services, society and companionship of her husband.”

Many injured guests have filed suit against property owners for injuries sustained on water slides, rollercoasters and other kinds of thrill rides. In one of the most infamous cases of theme park negligence, 8-year-old Danielle Foti lost part of her scalp when her hair caught in the machinery of a merry-go-round type ride, slamming her head into the back of her fiberglass seat. She received a $7.5 million settlement, and the park closed soon after.
