Lawsuits have been filed against FedEx and Bridgestone Tires after a semi-truck allegedly caused a fatal truck accident. According to the lawsuits, the FedEx truck caused a head-on collision by driving into oncoming traffic. Both lawsuits allege that the accident happened because the driver’s side tire on the semi-truck failed.
Bridgestone said in response that it takes product safety seriously, but according to the plaintiffs, recent information might suggest otherwise. The truck responsible for the accident had a tire blowout only two months prior to the truck accident. According to the lawsuit, the tire used to replace the first one lost to a blowout might have come from the same lot. The lawsuit contends that it was FedEx’s decision not to replace defective tires that had already failed once.
Attorneys representing the estates of the truck accident victims are asking for damages in excess of $75,000.
Are Truck Companies Responsible for Tire Failures?
Commercial carriers are required by Federal Motor Carrier Safety Administration (FMCSA) regulations to maintain equipment on vehicles. In some cases, products that cause motor vehicle accidents have significant defects, in which case a recall should be issued. In other cases, trucking companies will fail to maintain unsafe tires. For example, some companies might fail to check tire pressure, or use tires that do not meet the minimum Department of Transportation standards.
Whatever the cause might be, family members who have lost loved ones in accidents do have options. Contacting an attorney can be the first step in holding negligent commercial carriers accountable.
