Who is Liable in Winter Car Accidents?

A fatal car accident in Colorado claimed the lives of two people and seriously injured two others. A 78-year-old man and a 38-year-old woman, both traveling in the same car, sustained fatal injuries.

Two occupants in another vehicle, a 72-year-old woman and a 77-year-old man, required hospital treatment after the accident. The accident occurred when a Buick Lucerne lost control and slid into oncoming traffic. The crash happened on Christmas day.

Local police say that they do not expect drugs, alcohol or reckless driving as factors in the accident. Rather, they say that icy road conditions and strong winds were the main causes of the crash.

Can I File a Lawsuit If Bad Weather Caused the Accident?

Victims of car accidents caused by bad weather have fewer legal resources available compared to drunk driving accidents, distracted driving accidents and other types of crashes that clearly involved negligence. However, they may have options if:

  • The road was unsalted. Local municipalities are responsible for salting and clearing the road in bad weather conditions.
  • The other driver did not take proper precautions. Certain roads require chains in winter. If a driver failed to install chains or drove without the proper tires and spun out as a result, the other parties involved could sue for damages.
  • The other driver did not behave properly. Drivers must adapt to harsh conditions. Tailgating, weaving in and out of traffic and failing to slow down in a snowstorm could constitute negligence.

Most personal injury attorneys offer free consultations to those injured in serious car wrecks. There are options available to you if you lost a loved one in a car wreck or sustained a severe injury.
